JUSTICE SANJAY PRIYA ORAL ORDER 16-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Thawe P.S. Case No. 121 of 2016 instituted for the offence under Sections 399, 402 and 414 of the Indian Penal Code and Section 25(1-b) 26/35 of Arms Act.
It is alleged that one loaded country-made pistol and one live cartridge has been recovered from the possession of this petitioner.
There is allegation that some accused persons were making preparation of the dacoity. This petitioner alongwith others were apprehended. During search of the person of this petitioner the aforesaid fire-arm has been recovered. It is stated that the petitioner is in custody since
Patna High Court Cr.Misc. No.8745 of 2017 (2) dt.16-03-2017 2/2 11.09.2016.
Under such circumstances, keeping in view the period spent by the petitioner, the prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Thawe P.S. Case No. 121 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner. The petitioner is directed to remain physically present on each and every date during trial and in the event of default on two subsequent dates, the court below will be at liberty to cancel the bail bond of the petitioner. The petitioner will also cooperate in trial.
