JUSTICE SATYAVRAT VERMA ORAL ORDER 29-04-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 324, 325, 307, 506, 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. The learned counsel for the petitioner submits that the petitioner is in custody since 24.10.2022, he is a person with clean antecedent and the allegation against him is of assaulting the informant by lathi causing injury on his shoulder, which is said to be grievous.
4. The learned counsel for the petitioner submits that several accused persons had assaulted the informant and his
Patna High Court CR. MISC. No.8486 of 2023(2) dt.29-04-2023 2/2 wife. It is next submitted that from the side of the informant, Belhar P. S. Case No.171 of 2022 dated 08.05.2022 was instituted in which the informant and his side was made accused. It is next submitted that even petitioner suffered grievous injury.

The learned A.P.P. as well as learned counsel for the informant opposes the bail application, but are not in a position to rebut the submission of the petitioner that from his side the aforesaid Belhar P. S. was instituted in which the petitioner also sustained injury which is said to be grievous.
6. Considering the submission made by the learned counsel for the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Belhar P. S. Case No.170 of 2022.
7. The application stands allowed.
