The petitioner is languishing in custody for the offences punishable under Sections 8(c), 20(b)(ii)(B)/22/27(A) of the N.D.P.S. Act.

The FIR would reveal that the vehicle, from which more than 2 kg. of ganja was recovered, was not of the petitioner rather the services of the petitioner was hired as driver and the petitioner was not regular driver of that vehicle. Considering the aforesaid facts and statement of the petitioner on oath that he has got no criminal antecedent, let the petitioner, above named, who is in custody since 14.09.2020, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty

No.11969 of 2021(2) dt.27-07-2021 2/2 Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Special Case No. 138 of 2020 arising out of Athmalgola P.S. Case No. 222 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall not leave the country without permission of the trial Court.
