The petitioner seeks bail in connection with Sessions Trial No.336 of 2009 arising out of Raniganj P.S. Case No.230 of 2006 in which charge has been framed under sections 302 with 34 of Indian Penal Code. The prayer for bail of the petitioner was earlier rejected by this court on 28th January, 2014 in Cr. Misc. No.3764 of 2014 with following observation:- "Be that as it may, for the reasons recorded in earlier orders, I am not inclined to release the petitioner on bail at this stage. Accordingly, the prayer for bail is rejected. However, considering the period already undergone in custody by the petitioner as under-trial prisoner, I direct the
Patna High Court Cr.Misc. No.5625 of 2015 (2) dt.18-02-2015 2/2 learned Ad hoc Additional Sessions Judge-IV, Araria to take all possible steps in order to conclude Sessions Trial No.336 of 2009 within seven months from the date of receipt/production of a copy of this order, failing which the petitioner would be entitled to renew his prayer for bail."
It has been contended that till date only five witnesses could be examined in course of trial. Last witness was examined on 20th September, 2013 and since then no witness has come forward to depose in the court.
Having regard to the observation made in the aforesaid order dated 28th January, 2014, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IV, Araria in connection with Sessions Trial No.336 of 2009 arising out of Raniganj P.S. Case No.230 of 2006.
