The petitioners are languishing in custody since 04.11.2014 in a case registered for the offences punishable under Sections 25(1-B)1, 26, 27, 35 of the Arms and 47(a) of the Excise Act.

It is alleged that on information that the firing is going of between two groups the police raided the place and from the petitioner Binay Paswan seven live cartridges, from petitioner Chandan Paswan ten live cartridges and six used cartridges and from petitioner Chandu Kumar nine live cartridges were recovered.

No.5558 of 2015 (02) dt.13-02-2015 2/2 It is submitted by learned counsel for the petitioners that the petitioners have been framed at the behest of local Chaukidar against whom father of the petitioners lodged a case and in the background of land dispute the counter case has also been filed.

Considering the aforesaid facts, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Patna in connection with Phulwarisharif P.S. Case No. 699 of 2014.
