2. This criminal appeal has been filed against the order dated 28.09.2024 passed by learned 1st Additional Sessions Judge-cum-Special Judge (SC/ST) Act, Jehanabad in connection with Shakurabad P.S. Case No. 104 of 2024, registered under Sections 147, 148, 149, 341, 323, 337, 338, 353, 354, 307, 504, 506 of the Indian Penal Code and Sections 3(i)(r), 3(i)(s), 3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, whereby the prayer for anticipatory bail of appellant has been rejected.
3. As per prosecution case, on 2.6.24, during course of
Patna High Court CR. APP (SJ) No.150 of 2025(2) dt.23-01-2025 2/2 patrolling, informant received information that some altercation was going on in village Mirganj and after that he along with two lade constables reached at the place of occurrence. While the informant was trying to pacify the matter, in the meantime, 2025 villagers gathered there and started abusing them by caste name and also misbehaved with the lady constables. It is further alleged that all the F.I.R. named accused persons including this appellant attacked on the police force and assaulted informant with brick batting. This appellant was identified with the help of local chawkidar and villagers.
4. Considering the nature of accusation and the fact that appellant attacked the police party, I do not find any ground to interfere with the order of the learned court below and as such, the appeal, which has been filed for grant of anticipatory bail, is hereby rejected.
