JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-03-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 395 of the Indian Penal Code.

Petitioner is not named in the first information report but after seeing the video footage, the police suspected the hand of petitioner and subsequently, police arrested him and Rs. 5000/- was recovered from his conscious possession. It appears that except the aforesaid material and confessional statement of co-accused, there appears to be nothing against the petitioner, who does not have any criminal antecedent, which is evident from perusal of Para-3 of the petition.

Patna High Court CR. MISC. No.89 of 2020(3) dt.19-03-2020 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 210 of 2019.
