2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code.
3. The prosecution case in brief is that in order to grab land of the informant these petitioners presented forged and fabricated documents before SHO, Tikeshwar.
4. It is submitted on behalf of the petitioners that the petitioners are innocent and has falsely been implicated in this case. Due to land dispute between the parties this false and
Patna High Court CR. MISC. No.4014 of 2025(2) dt.19-02-2025 2/2 fabricated case is lodged against the petitioners. The allegation levelled against the petitioners is general and omnibus. It is further submitted that rent was fixed for the said land by the D.C.L.R vide rent case no. 1/2003-04 and Jamabandi has also been created in the name of Kamleshwri Devi who is mother of petitioner no.1. Petitioners have got no criminal antecedent.
5. Learned counsel for the State and learned counsel for the informant oppose the bail petition.
6. Considering the aforesaid facts and circumstances of the case, this bail application is allowed. In the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the J.M.F.C., Biroul-II, Darbhanga in connection with Kusheshwar Asthan P.S. Case No. 135 of 2019 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Suruchi/- U T
