JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-04-2021 In view of the submission and undertaking of the learned counsel for the appellant, at the time of hearing of this appeal, through Video Conferencing, that he would remove the defect(s), as pointed out by the Stamp Reporter, flagged at 'A', within four weeks of starting of the Court proceeding in physical mode in normal course, he is permitted to remove the same accordingly.

Learned counsel for the appellant, through Video Conferencing, submits that the appellant has already surrendered before the court below in this case and, as such, this appeal, which is directed against the order dated 18.12.2020 passed by the Additional Sessions Judge-I-cum-Special Judge (SC/ST Act), Lakhisarai, in A.B.P. No.863 of 2020, dismissing

Patna High Court CR. APP (SJ) No.1058 of 2021(2) dt.05-04-2021 2/2 the aforesaid A.B.P. No.863 of 2020 filed on behalf of the appellant to grant him the privilege of pre-arrest bail in connection with Lakhisarai P.S. Case No.176 of 2020, corresponding to SC/ST Case No.31 of 2020, being not maintainable, has become infructuous.

In that view of the matter, learned counsel for the appellant seeks permission to withdraw this appeal. Permission is accorded.

This appeal is dismissed as withdrawn.
