JUSTICE MADHURESH PRASAD ORAL ORDER 20-06-2023 The petitioner, as per communication dated 10.07.2019 bearing No. 158 issued by the Child Development Project Officer, Bachwara, was the second empanelled candidate in the provisional list prepared for selection of Anganwari Sevika.

It is submitted by learned counsel for the petitioner that the same did not culminate in any order appointing the petitioner.

Learned counsel for the State raises an objection that

Patna High Court CWJC No.1223 of 2020(3) dt.20-06-2023 2/2 such empanelment of the year 2019 cannot be made the basis of any direction by this Court today for the reason that mere empanelment does not vest any right in the petitioner's favour, based on which he can claim an indefeasible right to be selected. Secondly he submits that the empanelment is of July, 2019 and that the same has not culminated in any order of selection. Then today nearly 4 years thereafter, based on this old penal, no direction should be issued by this Court for petitioner's appointment.

The rival submissions have been considered by this Court and at this juncture, the petitioner's counsel submits that he has made an application before the District Programme Officer, Begusarai, raising his grievance regarding irregularity in the procedure of selection.

Without expressing any opinion on the merits of the said submission, with liberty to the petitioner to pursue his application dated 16.08.2019 (Annexure-5) before the appropriate authority in accordance with law, writ petition is disposed of.
