====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA MISHRA ORAL ORDER 08-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has been in custody since 02.12.2016 in connection with Kasim Bazar P.S. Case No. 153/2016 registered for the offences punishable under Sections 302/34/120(B) of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that though the petitioner is not named in the First Information Report his role is only that of a conspirator and that no specific role has been assigned to him. It is further submitted that he is not the assailant as indicated from the First Information Report. Diary in the present case was called for which has

It appears that one Ranjit Kumar is said to be the main assailant but Hemant Singh and Vicky who are said to be also part of conspiracy have since been extended the privilege of regular bail vide orders dated 01.07.2017 and 24.01.2018 passed in Cr. Misc. No. 29539 of 2017 and Cr. Misc. No. 877 of 2018 respectively.

Having considered the facts and circumstances of the case and that the petitioners stand similarly situated, let the let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additioanl Sessions Judge-V, Munger, in connection with Kasim Bazar P.S. Case No. 153/2016.
