JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-03-2019 This is an application for grant of anticipatory bail in connection with Jamui Mahila P.S. Case No. 79 of 2018, disclosing offences under Sections 379, 498A/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. Allegation against the petitioner is of subjecting his wife to cruelty and harassment with respect to demand. Submission of learned counsel for the petitioner is that the wife of the petitioner is a gruesome lady and she used to assault the petitioner and she herself left the house of the petitioner, which will appear from the statement of the witnesses during the course of investigation in paras 44, 45 and 46. Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Jamui, in connection with amui Mahila P.S. Case No. 79 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
