The name of petitioner came in this case in confessional statement of co-accused, Dhiraj Mishra on 04.09.2013 whereas the alleged occurrence took place on 26.07.2013. Moreover, even if the above stated confessional statement of co-accused assumed to be true, then also, it were coaccused, Dhirendra Mishra and Varun Mishra who opened fire on the deceased.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with
