ANJANA MISHRA ORAL ORDER 20-01-2020 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 16.11.2019 in connection with Special Case No.10155 of 2019 arising out of Bypass P.S. Case No.298 of 2019 registered for the offence under Sections 279/290/427 of the Indian Penal Code and Section 37(b)(c) of the Bihar Prohibition and Excise (Amendment) Act, 2016.

Learned counsel for the petitioner submits that mere allegation against the petitioner is that he was in an inebriated state and therefore, the police took him into custody. It is further submitted that the entire allegation is false and he is being falsely prosecuted and has no criminal antecedents. Considering the aforementioned facts and

Case No.298 of 2019).
