The petitioner is accused in connection with Prosecution C-1 Case No.367 of 2019/CIS No.367 of 2019 registered under Section 30(a) of the Bihar Excise (Amendment) Act, 2016. The accusation is of recovery of 33 pouches each containing 180 ml, 426 bottles each containing 375 ml Indian made foreign liquor from Maruti car in which the petitioner was found sitting.

Learned counsel for the petitioner submits that petitioner is neither driver nor owner of the vehicle. In the way petitioner took the lift and sat in the vehicle but at the time of checking driver succeeded to escape but the petitioner was apprehended. Petitioner has no criminal antecedent and is in custody since 10.12.2019.

No.464 of 2020(2) dt.20-01-2020 2/2 Having regard to the facts and circumstances of the case, the, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Second Additional Sessions Judge-cum-Special Judge (Excise), Purnea in connection with Prosecution C-1 Case No.367 of 2019/CIS No.367 of 2019.
