====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR SINHA ORAL ORDER 28-01-2026 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in connection with Barbigha P.S. Case No. 165 of 2025, registered for the offences punishable under Sections 190, 191(2), 191(3), 329(3), 115(2), 118(1), 109, 303(2), 74 and 352 of the BNS, 2023.

3. The case of the prosecution, in short, is that the informant, namely, Shiv Kumari and her family members were sleeping in her house then (i) Garib Ravidas @ Gariban Ravidas (ii) Kaushalya Devi (iii) Lalan Kumar @ Lalan Ravidas. (iv) Bhagwan Das (v) Sanjay Ravidas (vi) Pindo Ravidas and other

No.1277 of 2026(2) dt.28-01-2026 2/3 5-6 unknown persons entered in her house and abused her and her daughter-in-law and assaulted by iron rod and lathi (stick) which cut the left hand of informant and her husband Prakash Ravidas got severe injury on forehead. Her daughter-in-law forearms also got injured. It is further alleged that accused persons also assaulted the ex-mukhiya by iron rod due to which he sustained injury and got admitted in Patna AIIMS for treatment. The co-accused persons along with the petitioners snatched mangal sutra from the neck of her daughter-in-law.

4. The allegations against the accused petitioners are of assault to the informant and her family members while they were sleeping in their house. The injury report of the informant/victim and other injured persons reveal that injury sustained by injured Shailendra Ravidas is grievous in nature, Prakash Ravidas has sustained injury over vital organ of the body i.e., right eye and Shiv Kumari has sustained injury over left forearm. Learned Court below has perused the Case Diary and observed that vide paragraph nos. 11, 12 and 13, the witnesses have supported the allegation against the accused persons.

5. Learned A.P.P. for the State opposes the prayer of anticipatory bail.

6. Considering these aspects of the matter, particularly when there is allegation of direct assault on abdomen by the accused persons in the alleged offence, the Court is not inclined to grant anticipatory bail to the petitioners. (Alok Kumar Sinha, J) Gaurav Sinha/- U
