1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner has preferred this application for grant of regular bail in connection with Bettiah Muffasil (Manuapul) P.S. Case no. 566 of 2023 registered under sections 147, 148, 149, 341, 323, 353, 332, 333, 504 and 506 of the Indian Penal Code.
3. As per the prosecution case, while the informant and other police personnel, on receiving information about some fight in the house of one Mukesh Giri had gone to visit the house, it is stated that the local villagers including the petitioner and others started to abuse and assault them. The informant and other police personnel somehow managed to escape.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case because of his
Patna High Court CR. MISC. No.4172 of 2024(2) dt.31-01-2024 2/2 antecedents. No such occurrence as alleged in the F.I.R has taken place. No injury report has been brought on record. The petitioner is in custody since 20.10.2023 and charge-sheet has been submitted in the case.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner, the petitioner being in custody since 20.10.2023 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Bettiah Muffasil (Manuapul) P.S. Case no. 566 of 2023, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah.
