Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code.

There is allegation against the petitioner and other F.I.R. named accused persons that they demanded extortion money from the informant and when their demand was not fulfilled, they assaulted the informant and it is specifically stated that petitioner snatched cash from the informant. Submission on behalf of the petitioner is that petitioner and informant are agnates and as a matter of fact, on account of land dispute, the informant lodged this false case. It is

No.23819 of 2016 (3) dt.13-07-2016 2/2 further submitted that some altercation had taken place between the parties outside the campus of F.C.I. godown and in that altercation, informant sustained simple injury but he managed the police and got instituted the present case with exaggerated story. No doubt, petitioner carries criminal antecedent but considering the facts and circumstances of the case as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Obra P.S.
