This is an application for bail in connection with Bhagwanpur P.S.Case No. 54 of 2016 registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code and 3/4 of Dowry Prohibition Act.
Petitioner is the husband of the deceased and the case is under Section 304B IPC.
It has been submitted on behalf of the petitioner that deceased was lying ill and she was being treated and due to illness she died and in support of his contention documents at Annexure2 have been filed. It has further been submitted that charge-sheet in this case has been submitted and petitioner is in custody since
Patna High Court Cr.Misc. No.16793 of 2017 (5) dt.05-05-2017 2/2 23.9.2016.
Heard learned APP also, who has opposed the prayer for bail.
Having heard both sides and considering the allegation of cruelty and demand of dowry and also considering the post mortem report which shows that deceased died due to strangulation, I am not inclined to grant bail to the petitioner. Prayer for bail is rejected.
