JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Taking into consideration that the case was lodged in the year 1998 and after investigation, police submitted charge sheet against the petitioner for the offences punishable under Sections 302, 201/34 of the Indian Penal Code but the appearance of the petitioner could be ascertained by the concerned court on 27.06.2014 and prior to that he was declared absconder, I am not inclined to grant the privilege of bail to petitioner and hence, his prayer for bail in connection with Sessions Trial No. 1027 of 2014 arising out of Jokihat (Mahalgaon) P.S. Case No. 43 of 1998 pending in the court of 1st Additional Sessions Judge, Araria stands rejected.
