Petitioner renews his prayer for bail in connection with N.D.P.S. Case No. 02 of 2020 arising out of Ara Nawada P.S. Case No. 100 of 2020 registered for the offence under Section 21 / 22 of the N.D.P.S. Act inasmuch as earlier the bail application of the petitioner was rejected by this Court by order dated 25 / 11 / 2020 passed in Cr. Misc. No. 30094 of 2020 granting liberty to the petitioner to renew his prayer for bail after one year if the trial does not show any progress.

Patna High Court CR. MISC. No.2701 of 2022(3) dt.09-03-2022 2/3 238 grams of Heroin and Rs. 4 lakhs have allegedly been recovered from the possession of the petitioner. Learned counsel for the petitioner submits that petitioner is in custody since 31 / 01 / 2020. This court vide its order dated 02- 02 -2022 has called for a report regarding the progress of the trial and in pursuance thereof the report has been furnished by learned 2nd Additional District and Sessions Judge, Bhojpur, Ara vide letter no. 8 / 22 dated 23 - 02 - 2022 and from perusal of the same it appears that charge has been framed on 01 / 02 / 2022, out of five charge sheet witnesses one witness has been examined, next date is fixed for 25 - 02 - 2022, Special Public Prosecutor (N.D.P.S.) has been directed to ensure examination of remaining four witnesses and the learned 2nd Additional District and Sessions Judge, Bhojpur, Ara has given the estimated time for completion of the trial within three months.

In view of the fact that trial is at the verge of completion, I am not inclined to consider the prayer for bail of the petitioner at this stage.

Accordingly, the same is rejected.

However, if the trial does not conclude within three months, petitioner may approach this court again for grant of
