The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, seeing the police personnel, it is stated that two accused persons abandoned their motorcycle and managed to flee away. The local person identified the petitioner among the two. On search, 50 litres of country liquor was recovered.

It is submitted by learned counsel for the petitioner that neither the petitioner was arrested at the spot nor has he any concern with the motorcycle in question or with the seized

Patna High Court CR. MISC. No.1866 of 2022(2) dt.03-02-2022 2/2 liquor. He has been falsely implicated in the case because of his antecedent. He is in custody since 25.10.2021 and chargesheet has been submitted in the case.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case specially the petitioner not having been arrested at the spot, the Court directs the petitioner to be enlarged on bail in connection with Kothi P.S. Case no.40 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge, Excise Act, Gaya.
