1. Heard learned counsel for the petitioner and learned A.P.P. for the State Mr. Ajay Mishra.
2. The petitioner apprehends his arrest in connection with Andhramath P.S. Case No.164/2023 registered for the offence punishable under Sections 420, 467, 468, 471, and 120(B) of the Indian Penal Code.
3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated with an allegation that he secured appointment of a teacher based on forged and fabricated certificates. It is next submitted that had an opportunity been given to the petitioner seeking his explanation perhaps the petitioner would have been in a position to authorities about the genuineness of his certificates but then based on an ex-parte
Patna High Court CR. MISC. No.4322 of 2024(2) dt.15-02-2024 2/2 inquiry carried behind the back of the petitioner, the present F.I.R. came to be instituted. The learned counsel for the petitioner at this stage submits that though petitioner is innocent but since he has been implicated in the present false case as such he will tender his resignation subject to the outcome of the criminal proceeding.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Jhanjharpur, Madhubani in connection with Andhramath P.S. Case No.164/2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
