Heard learned counsels for the petitioner and the State.

The petitioner is languishing in custody since 09.01.2015 in a case registered for the offences punishable under Sections 147, 149, 341, 342, 337, 332, 379, 435, 353, 307 of the Indian Penal Code and 3/4 of the Prevention of Damage to Public Property Act.

It is alleged that seven FIR named accused persons including the petitioner and several unknown were assaulting a person who alleged to have established forceful physical relationship with seven years old girl and thereafter killed her when police came, the mob got agitation and burnt the police

It is submitted by learned counsel for the petitioner that the accusation is against the mob who agitated due to non-action of the police against the accused hence to save their skin the police has lodged the present case. The FIR was registered on 25.10.2014 but reached to the court on 28.10.2014 which suggests that antedating was done.

Considering the accusation against the mob, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Panapur P.S. Case No. 136 of 2014.
