JUSTICE KHATIM REZA ORAL ORDER 01-03-2024 Learned counsel for the petitioner submitted that the petitioner has already taken recourse against the ex parte judgment under Order IX Rule 13 CPC before the learned court below therefore, he wants to withdraw this Civil Revision application.

2. It is also submitted that a Miscellaneous Case bearing Miscellaneous Case No. 163 of 2018 has been filed under Order IX Rule 13 CPC before the learned Sub Judge II, Siwan on 29.10.2018.

3. In view of the facts and circumstances of the case, learned counsel for the petitioner is permitted to withdraw this Civil Revision application to pursue the Miscellaneous Case No.

Patna High Court C.R. No.5 of 2024(3) dt.01-03-2024 2/2 163 of 2018. The learned Sub Judge II, Siwan is directed to dispose of the Miscellaneous Case No. 163 of 2018 within a period of one year.

4. Accordingly, this Civil Revision application is dismissed as withdrawn.
