The petitioner seeks bail in a case for the offence punishable under Sections 20 and 22 of the N.D.P.S. Act.

The allegation against the petitioner is that after seeing the police personnel she tried to leave the bus and a bag was found near the seat. On query, she did not reply. Thereafter, the bag was searched and about 4 kg. ganja was recovered from that bag.

It is submitted that the petitioner has no concern with that bag. She has no criminal antecedent. Moreover, the recovered quantity of ganja was less than commercial quantity. The petitioner has been in custody since 10.10.2014 and there is no chance of tampering with the witnesses.

No.6440 of 2015 (2) dt.20-02-2015 2/2 Considering the facts and circumstances of this case, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J., XI, Patna, in Jakkanpur P. S. Case no. 404 of 2014 ( now Special Case no. 70 of 2014) with the following conditions :

1. One of the bailors will be the close relative of the petitioner.

2. The petitioner will not indulge in similar or in any other offence.

3.

The petitioner will be well represented in the court.

4. In case of absence for two consecutive dates or in violation of the terms of the bail, her bail bond will be liable to be cancelled by the court concerned. (Amaresh Kumar Lal, J) sudip/- U T
