JUSTICE JYOTI SARAN ORAL ORDER 09-08-2016 This matter has been listed under the heading 'For Orders' pointing out a defect regarding non-service of a copy of the writ petition on the learned counsel for the Bank of Baroda. Upon service today, Mr. Vivek Prasad, learned counsel appears and accept notice on behalf of the Bank of Baroda. Since the defect is removed hence with the consent of the parties the matter has been taken up for consideration on merits.

The petitioner makes a complaint regarding nonpayment of subsistence allowances with effect from 4.9.2014. Mr. Prasad, learned counsel appearing for the Bank

Patna High Court CWJC No.12675 of 2016 (2) dt.09-08-2016 informs on instructions that the petitioner has since been provided with the subsistence allowance.

Mr. Vivek Prasad, learned counsel appearing for the Bank of Baroda further mentions that the disciplinary authority i.e. the Regional Manager, Bank of Baroda, Purnea has not been impleaded.

Learned counsel for the petitioner is permitted to implead the disciplinary authority as respondent no.3 to the present proceeding during the course of the day. Having heard learned counsel for the parties and in view of the statement made by Mr. Prasad at the Bar, the writ petition is disposed of with a direction that in case the subsistence allowance has not been paid the same should be paid along with its arrears within four weeks from the date of receipt/production of a copy of this order.
