2. The appellant apprehends his arrest in Asthawan P.S. Case No. 113 of 2020 registered for the offences punishable under Sections 341, 302 of the Indian Penal Code and Section 3(2)(v) of the SC/ST Act, pending in the Court of learned 3rd Additional Sessions Judge-cum-Special Judge SC/ST, Biharsharif, Nalanda.

3. After some arguments, learned counsel for the appellant seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, the instant application is dismissed as withdrawn. However, if the appellant surrenders before the learned Court below within a period of six weeks from today

Patna High Court CR. APP (SJ) No.125 of 2022(5) dt.16-08-2023 2/2 and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order, considering the fact that there is no specific allegation against the appellant.
