Petitioner is apprehending arrest in connection with Muffasil P.S. Case No. 470 of 2019 for the offence under sections 414, 120B, 34 of the Indian Penal Code and Section 30(a)/41 of the Bihar Prohibition and Excise (Amendment) Act, 2018.
In the instant case total 4370.190 liters of foreign liquor was seized.
Learned counsel for the petitioner submits that liquor was seized from the truck and the pick up van and not from the conscious possession of the petitioner or to the house of the petitioner. The petitioner has no concern with the truck, pick up van or the seized liquor.

No.2213 of 2020(3) dt.09-07-2020 2/2 Considering the aforesaid, the Court is inclined to grant anticipatory bail to the petitioner, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 100000/- (One lakh) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 2nd cum Special Judge, Excise Act, Begusarai, in connection with Muffasil P.S. Case No. 470 of 2019 subject to the condition as laid down under section 438(2) of the Cr.P.C. with further condition that the petitioner shall deposit Rs. 100000/- (One lakh) cash to the court below and the amount deposited by the petitioner shall abide by final outcome of the pending criminal case.
