JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-08-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the sister of the informant is languishing in custody since 17.6.2014 in a case registered for the offences punishable under Sections 498A and 304B/34 of the Indian Penal Code and sections 3 and 4 of Dowry Prohibition Act.
The accusation is of killing the sister of the informant within two years of marriage for non fulfillment of dowry demands.
It is submitted by the learned counsel for the petitioner that the victim died due to accidental fire since she fell from the roof of the house.
It is submitted by the learned APP, after going through
Patna High Court Cr.Misc. No.23473 of 2016 (3) dt.10-08-2016 2/2 the case diary that the injury report as well as postmortem report reflect that the victim was throttled to death. Considering the nature of accusation, this court is not inclined to grant bail to the petitioner in connection with Belaganj P.S. Case No. 77 of 2014 pending in the court of learned 9th Additional District and Sessions Judge, Gaya. This application is, accordingly, dismissed.
However, since the investigation has already concluded, the learned trial court is expected to conclude the trial expeditiously. (Dinesh Kumar Singh, J) Anil/- U T
