JUSTICE SUDHIR SINGH ORAL ORDER 17-02-2022 Due to the third wave of COVID-19 Pandemic, the matter is being taken up by way of Virtual Court proceeding. The matter has been listed under the heading 'For Orders' under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioner and learned APP for the State through virtual mode.

Learned Counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks after restoration of normalcy. The petitioner is apprehending his arrest in connection with Basopatti P.S. case No.119 of 2017 corresponding to C.R.I. case No.1239 of 2017 registered under Sections 304(B)/120(B)/34 of the Indian Penal Code, pending in the court of Sri Raushan Kumar Chhapolia, J.M. 1st class,

The earlier bail application of the petitioner was rejected vide Annexure 1 to the present application by a Coordinate Bench of this Court. I find no reason to interfere with the earlier order passed by a Co-ordinate Bench of this court. Said order was passed on 29.07.2019. After a period of more than two and half years, the present application has been made. The anticipatory bail application is dismissed. If the petitioner surrenders before the court below and prays for regular bail, same shall be considered on its own merit without being prejudiced by this order.
