The petitioner is languishing in custody since 29.08.2014 in a case registered for the offences punishable under Sections 457, 380 and 308 of the Indian Penal Code. The accusation is of committing theft in the house of the informant. The petitioner was caught on the spot. It is submitted by learned counsel for the petitioner that only on suspicion the petitioner has been caught when no recovery was made from the petitioner. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount

Patna High Court Cr.Misc. No.6827 of 2015 (02) dt.23-02-2015 2/2 each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 464 of 2014.

Since the petitioner is accused in two other cases, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
