The petitioner seeks bail in anticipation of his arrest in connection with Town P. S. Case No. 08 of 2018 dated 05.01.2018 instituted for the offences under Sections 272 and 273 of the Indian Penal Code and Sections 30(a), 38(2), 41(I) and 47 of the Bihar Prohibition and Excise Act, 2016.

25 litres of liquor is said to have been recovered from a Sumo vehicle. It has been alleged in the F.I.R. that petitioner along with three others were traveling in the aforesaid vehicle. Three of the other associates of the

Patna High Court Cr.Misc. No.3343 of 2019(2) dt.24-01-2019 2/2 petitioner were arrested but the petitioner managed to effect his escape.

This Court is not inclined to grant anticipatory bail to the petitioner only for the reason that earlier also he has been made accused in this other case of similar nature. The prayer for anticipatory bail is rejected. In case the petitioner surrenders before the court below and seeks bail, the court below shall take into account all the relevant facts and pass orders in accordance with law without being prejudiced with the fact that the present petition has not been entertained by this Court.
