The present writ application has been filed for a direction to the Respondent No.3 i.e., Circle Officer, Chausa, Buxar to dispose the mutation application filed by the petitioner. Learned counsel for the petitioner submits that the petitioner filed a Mutation Case before Respondent No. 2. The Respondent No. 2 passed an order in Mutation Case bearing No. 85/11-12 dated 24.11.2011 directing the petitioner to file a petition before Respondent No.3, i.e., Circle Officer, Chausa for mutation and in pursuance thereof, the petitioner filed a petition on 22.12.2011 which has been acknowledged by Respondent No.3 i.e., Circle Officer, Chausa, on 13.01.2012 as would be evident from Annexure-3.

The submission is that since 13.01.2012, the claim of

Patna High Court CWJC No.1058 of 2018(2) dt.13-01-2023 2/2 the petitioner for mutation of the subject land purchased by the petitioner by virtue of sale deed at Annexure-1 has not been decided by the Circle Officer.

Learned counsel for the State submits that the Circle Officer, Chausa, Buxar may be directed to take a decision upon the application for mutation filed by the petitioner within a reasonable time frame.

Taking into consideration the rival submission of the parties and the fact that the mutation petition filed by the petitioner is pending with the Circle Officer for the last ten years, I direct the Respondent No.3 i.e., Circle Officer, Chausa, Buxar to dispose the petition filed by the petitioner for mutation within a period of three months from the date of production/receipt of a copy of this order.

With the observation and direction made above, the petition stand disposed of.
