The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code.

As per allegation in the F.I.R., accused persons on a motorcycle on the point of pistol looted the informant of Rs.1.2 lacs.

It is submitted by learned counsel for the petitioner that F.I.R. was registered against unknown. The petitioner was arrested on the basis of suspicion that as per C.D.R. of his mobile phone he was in the area. It is submitted that the petitioner is being falsely implicated stating that Rs.3700/ found

Patna High Court CR. MISC. No.12397 of 2021(3) dt.30-07-2021 2/2 from his home was part of the looted money. There is no basis to connect the money recovered to the looted amount. No incriminating article has been recovered from his possession. He has not been put on T.I. parade and is in custody since 14.7.2020.

Having heard learned counsel for the parties and taking into consideration the petitioner having remained in custody for more than 1 year, the Court directs the petitioner to be enlarged on bail in connection with Jalalgarh P.S. Case no.63 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea.
