JUSTICE BIRENDRA KUMAR ORAL ORDER 20-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 7/8/13(2)/13(1)(d) of the P.C. Act.

According to F.I.R. co-accused Sunil Kumar Dutt, who was Investigating Officer of a case, was trapped while receiving gratification of Rs.5,000/-. Further allegation is that Sunil Kumar Dutt handed over the money to the petitioner, who was standing nearby.

Submission of the petitioner is that the petitioner is neither the government servant nor a relation of Sunil Kumar

Patna High Court Cr.Misc. No.9137 of 2017 (3) dt.20-03-2017 2/2 Dutt nor was a driver of the vehicle; rather he has falsely been implicated on suspicion. The petitioner has got no criminal antecedent.

Considering the nature of allegation against the petitioner, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance, North Bihar, Muzaffarpur/Successor Court, in connection with Spl. Case No.68 of 2016, arising out of Vigilance P.S. Case No.148 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
