JUSTICE MOHIT KUMAR SHAH ORAL ORDER 24-06-2022 The present writ petition has been filed for directing the Circle Officer, Samastipur ie. the Respondent No.4 herein to remove the encroachment from public pathway situated over Government land appertaining to plot no. 306 and khata no. 628.

At the outset the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Samastipur by filing appropriate petition under the provisions of Bihar Public Land Encroachment Act, 1956. Liberty so sought is granted.

The present writ petition stands disposed of with a

Patna High Court CWJC No.434 of 2019(2) dt.24-06-2022 2/2 further direction that in case appropriate petition is filed by the petitioner within a period of four weeks from today, before the Circle Officer, Samastipur, he shall take appropriate steps in accordance with law and pass necessary orders in accordance with law, after issuance of notice and hearing the effected parties within a period of eight weeks, thereafter.
