JUSTICE AMARESH KUMAR LAL ORAL ORDER 26-02-2015 Heard the learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is in custody since 02.04.2014 in a case registered for the offence punishable under Sections 341, 452, 323, 504 and 302/34 of the Indian Penal Code. The allegation against the petitioner is to have given a knife blow to the deceased, which caused his death. It is submitted that the police has already submitted chargesheet against the petitioner. Cognizance has been taken and charge has also been framed. There is no chance of tampering with the evidence.

Considering the facts and circumstances of this case that the petitioner is alleged to be the main assailant and the trial is

Patna High Court Cr.Misc. No.6436 of 2015 (2) dt.26-02-2015 going on, in my opinion, the petitioner does not deserve bail at this stage, the prayer is rejected.

Let the trial be expedited.
