The petitioner seeks bail in connection with Deepnagar P.S. Case No.228 of 2015 registered under Sections 304(B) and 201/34 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, Nalanda at Biharsharif.
The accusation is of killing the deceased, the sister of the complainant/informant, for non fulfillment of the demand of dowry by her husband (petitioner) and other in-laws and also to dispose of her dead body.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is the husband of the deceased, the
Patna High Court Cr.Misc. No.6048 of 2017 (3) dt.06-04-2017 2/2 sister of the complainant/informant, and has falsely been implicated in this case. The complaint case, which is the basis of the F.I.R., was lodged after 13 days of the occurrence by the complainant/informant, who is the brother of the deceased. In fact, the deceased, the sister of the complainant/informant, sustained burn injury in course of cooking meal and she was rushed for treatment but she died and after lodging of the complaint case, the complainant/informant has also filed an application in the trial court to that effect. The petitioner is in custody since 29.11.2016.
Having regard to the facts and the circumstances of the case and the nature of allegation, I am not inclined to grant bail to the petitioner. Accordingly, the prayer of the petitioner for grant of bail stands rejected.
