Petitioner is in jail custody since 27.7.2014 in a case registered under sections 307, 353 of the Indian Penal Code, section 27 of the Arms Act and section 3/ 4 of the Explosive Substance Act. No doubt, petitioner is named in the first information report and he carries criminal antecedent of several cases but no specific overt-act has been attributed against him and having more or less similar allegation co-accused Guddu Kumar has already been granted privilege of bail by a coordinate bench of this court. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in Gopalganj Town P.S. Case no. 317/2014 subject to the condition that petitioner shall attend the learned trial court in person
Patna High Court Cr.Misc. No.17309 of 2015 (3) dt.03-09-2015 on each and every date for the period of one year or till conclusion of his trial whichever is earlier and if he fails to do so on three consecutive dates without any reasonable explanation, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner. shahid (Hemant Kumar Srivastava,J) U T
