====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 15-02-2023 Heard learned counsel for the petitioner and learned APP for the State.

The learned counsel for the petitioner submits that petitioner was granted bail by order 16.11.2022 in Cr. Misc. No.60244 of 2022 whereby he was granted six weeks' time to surrender.

It is next submitted that the date of surrender ended on 27.12.2022. It is next submitted that petitioner realizing his difficulty on account of some personal reason that he may not be able to surrender by the last date, as such, sought modification of the order dated 16.11.2022 in Cr. Misc. No.60244 of 2022 for getting the period of surrender extended.

It is further submitted that the application seeking

Patna High Court CR. MISC. No.9974 of 2023(2) dt.15-02-2023 2/2 modification of the order dated 16.11.2022 was filed on 21.12.2022 i.e. much before the last date of surrender as is evident from filing acknowledgment.

Considering the submissions made by the learned counsel for the petitioner, in the event, if the petitioner surrenders on or before 27.02.2023, his bail bond shall be accepted.

The order dated 16.11.2022 passed in Cr. Misc. No.60244 of 2022 is modified to the extent indicated above. The modification application is allowed.
