JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-02-2015 Petitioner is languishing in custody since 19.11.2014 in a case registered for the offences punishable under Sections 379, 411, 461 of the I.P.C.

It is alleged that theft was committed in the sanitary shop of the informant. Two persons were apprehended while they were loading stolen pipes on a pick-up van. The petitioner was night guard of the area where shop was situated. It is submitted by learned counsel for the petitioner that petitioner has no criminal antecedent and at best he was negligent on his duty.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.5854 of 2015 (2) dt.13-02-2015 2/2 bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 668 of 2014.
