The petitioner seeks regular bail in Bhagwanganj P.S. Case No. 127/2018, registered for the offence punishable under Section 414 of the Indian Penal Code.
In the written report it is alleged that on confidential information that stolen motorcycle is kept in the house of this petitioner, the police committed raid and recovered the stolen motorcycle. It is alleged that for the aforesaid motorcycle there is already a case filed about one and half years back being Masaurhi P.S. Case No. 62/2017.
Learned counsel for the petitioner has submitted that there is no recovery of any incriminating article from possession of this petitioner. Petitioner has no concern with the aforesaid
Patna High Court Cr.Misc. No.3566 of 2019(2) dt.01-02-2019 2/2 motorcycle. The house was joint house and the aforesaid motorcycle was recovered from one of the room of joint house. Petitioner is in custody since 03.09.2018.
Considering the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Masaurhi, Patna in connection with Bhagwanganj P.S. Case No. 127/2018, subject to the condition that both the bailors will be close relative of the petitioner. (Sanjay Priya, J) vinita/- U T
