2. The petitioner is in custody since 03.02.2016 in connection with Narpatganj P.S. Case No. 22 of 2016 for the offences alleged under Sections 447, 341, 323, 326A, 307, 435, 504/34 of the Indian Penal Code and 3 (i)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.

3. It is submitted that the petitioner has been falsely implicated and is not an F.I.R. named accused. His name has transpired subsequently as order-giver in the statement of two witnesses in course of investigation but however according to the F.I.R. the order-giver was co-accused Surendra Thakur.

4. Having regard to the entirety of the facts and circumstances of the case, let the petitioner Upendra Yadav be
