The petitioner apprehends his arrest in connection with Bibhutipur P.S. Case No. 171 of 2019 registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.
Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to ill motive. Further submission is that the alleged recovery has been made from the orchard which is situated in front of the house of the petitioner and the said orchard belongs to one Arjun Singh. The motorcycle which belongs to the petitioner was parked in front
Patna High Court CR. MISC. No.2271 of 2022(2) dt.06-05-2022 2/2 of his house but due to suspicion the informant also seized the motorcycle but from the said motorcycle nothing has been recovered. Petitioner has no criminal history. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the A.D.J.-II-cum-Special Judge, Excise Act, Samastipur in connection with Bibhutipur P.S. Case No. 171 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
