Mr. Pawan Kumar Chaurasia, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 31-01-2025 Heard learned counsel for the petitioner as well as learned APP for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 323, 341, 307, 504, 506/34 of the Indian Penal Code in connection with Matihani P.S. Case No.165 of 2023.

3. The learned counsel for the petitioner submits that the petitioner had earlier moved this Court seeking regular bail by filing Cr. Misc. No.73000 of 2024 and the same was permitted to be withdrawn with liberty to the petitioner to renew his prayer for bail after framing of charge. It is next submitted that charges against the petitioner has been framed on 25.11.2024 (Annexure-4).

4. The learned APP for the State opposes the bail

5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District & Additional Sessions Judge, VIII, Begusarai in connection with Matihani P.S. Case No.165 of 2023.

6. However, in the event if the learned trial court comes to a conclusion that petitioner after being released on bail is trying to delay the trial in any manner, the trial court would be at liberty to cancel the bail bonds of the petitioner after recording reasons.

7. The application stands allowed.
