The petitioner is languishing in custody for the offence punishable under Section 395 of the I.P.C. and later on, Section 412 of the I.P.C. has been added.

The FIR of the occurrence of dacoity is against unknown.

Submission is that co-accused Rahul Kumar was arrested along with looted tractor and he disclosed the name of the petitioner. Besides confessional statement of co-accused before the police while in police custody, there is no other material against the petitioner. Investigation of the case is already complete.

No.11976 of 2021(2) dt.27-07-2021 2/2 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Beldour P.S. Case No. 140 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall not leave the country without permission of the trial Court.
