The petitioner being the brother-in-law of the husband of the informant is apprehending his arrest in a case registered for the offences punishable under sections 341, 323, 314, 379, 498A, 504, 506, 120B of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
The prosecution case is that the informant's husband, father-in-law, mother-in-law, brother-in-law and sister-in-law of the complainant tortured the informant. It is alleged that all the accused persons including the petitioner in connivance with each other demanded a Scorpio. It is alleged that the informant was assaulted by her husband, sister-in-law Poonam Devi and brotherin-law Shrawan Choudhary, as a result she received injury. It is alleged against the petitioner that the petitioner snatched Mangal
Patna High Court Cr.Misc. No.30235 of 2016 (2) dt.22-07-2016 Sutra from the neck of the informant.
Learned counsel for the petitioner submits that the petitioner got married with the sister of the husband of the informant in the year 1999 and since then he is living in the village with his wife.
Considering the thrust of accusation against the husband of the informant and other accused persons, let the abovenamed petitioner be released on anticipatory bail, in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Darbhanga in Manigachhi P.S. Case No. 66/2016, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
