Petitioner seeks bail in connection with Majhauliya P.S. Case No. 651 of 2022, F.I.R. dated 03.09.2022 registered for the offences punishable under Sections 447, 341, 323, 379, 307, 354B, 337/34 of the Indian Penal Code and later on Section 302 of the Indian Penal Code was added.

Allegation against the petitioner is of committing murder of the wife of the informant and assaulting to the informant.

Learned counsel for the petitioner submits that the petitioner has clean antecedent and he has been falsely implicated in the present case. He further submits that the

Patna High Court CR. MISC. No.3681 of 2023(4) dt.17-07-2023 2/2 allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offence as alleged in the F.I.R. Learned counsel appearing on behalf of the Informant as well as learned APP for the State, on the other hand, on the basis of material available on record and the case diary, vehemently opposed the prayer for bail and submits that there is direct and specific allegation against the petitioner that he has assaulted with iron rod to the deceased and the postmortem report also supports the allegation as alleged in the F.I.R. Considering the aforesaid facts that there is direct and specific allegation against the petitioner which was supported by the medical evidence, I am not inclined to enlarge the petitioner on bail in connection with Majhauliya P.S. Case No. 651 of 2022 pending in the Court of learned Chief Judicial Magistrate, Bettiah, West Champaran.

Prayer is refused.
