JUSTICE ARUN KUMAR ORAL ORDER 15-03-2017 Heard learned counsel for the petitioner, learned counsel for the Vigilance and learned counsel for the State. The petitioner, already in custody, seeks bail in connection with Special Case No. 67 of 2016, arising out of Vigilance P.S. Case No. 149 of 2016 registered under Sections 7/13(2), 13(1) (d) of the Prevention of Corruption Act, 1988. Allegation in brief is that the petitioner is the Programme Officer and in a trap case Rs. 20,000/- was recovered as alleged to be making demand of money from clearing the bills of MANREGA labourers.

Learned counsel for the petitioner submits that the allegation levelled against the petitioner is completely false and

No.9310 of 2017 (2) dt.15-03-2017 2/2 the Mukhiya, who is informant, due to some personal grudge, has implicated the petitioner and in fact, now the labour charges of the MANREGA labourers directly goes to their account and this petitioner has been in custody in this case since 24.12.2016 and in this case after investigation, Police has submitted the charge sheet. Having considered the aforesaid facts and circumstances, the petitioner, namely, Manish Kumar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Special Judge Vigilance, North Bihar, Muzaffarpur in connection with Special Case No. 67 of 2016, arising out of Vigilance P.S. Case No. 149 of 2016.
